If i were to draft a law regulating the use of solitary confinement, some elements i would contain is the maximum length of time for an inmate. I believe that keeping an inmate in solitary confinement for 5 years is a little to much for what they did inside even though it doesnt reflect what they did to get in jail. I would make it like a month and see how they do back with the others. Unless its a repeated offense then i would extend there total number of years in jail for then solitary confinement cause there going to be in there anyways whys it matter if there with others not like there allowed to talk at all. Creating more solitary confinement cells is going to cost more money then we already need to spend on these criminals.
I would restrict the prison officials discretion because they shouldn't be able to make up a number for the consequences for inmates. I would have some type of format that they should go by for like what is it that they are doing inside the jail to have them placed in whatever for example solitary confinement. That way its fair for everyone, everyone's happy its going to be a good day.
I wouldn't allow the prisoners a challenge to there solitary confinement in court because it would only be for a month unless its a repeated offense. There already in jail for a reason why should they be challenged in court for solitary confinement. It would just take up to much time and money for that to happen. Its their own actions that get them place there in the first place so why bother trying to help them.
